Plans and Powers of the Provisional Government of the Republic of Georgia
Preamble
We, the People of the Republic of Georgia, by the grace and beneficence of
God do ordain and reestablish its Lawful position among the sovereign
nations of the earth in accordance with God's Common Law and the law of
nations, and by these acts, reestablish the Government of the Republic of
Georgia by this its provisional mode. This act formally dissolves the
military rule which has existed over its soil since its inception.
Prayer
It is with solemn resolve and respect that the People of the Republic of
Georgia renew their commitment towards unifying the people of Georgia
and to act with whatever aid is possible in salvaging their God-given Rights,
their lands and sovereignty. With all prayer, the People of the Republic of
Georgia shall, where possible, help in fostering world peace and friendship
and respect to all cultures and religions as private and sacred to all human
beings. It is to that end that we and our posterity are now committed.
Article 1
Authority, The Law of Nations
In accordance with the law of nations, and 'The Petition and Declaration
of Dependence on God; Renewing the Covenant', dated October 9, in the year
of our Lord, two-thousand, the Republic of Georgia, by and through
the acts of its Citizens, have now brought about the reconstitution of the Lawful
de jure Provisional Government of the Republic of Georgia. It is to that
reconstitution that this provisional government is now hereby instituted to
serve until a Constitutional Convention is convened and a fully
operational de jure Republic that endeavors to fully protect and
defend our God-given Rights is instituted.Article 2
Constitutional Basis
The Provisional Government of the Republic of Georgia and its Citizens
hereby adopt and incorporate as a basis of its constitutional foundation:
The 1599 Geneva Christian Holy Bible: The Bible of the Pilgrims;
The Declaration of Independence in 1776 where it says:
"When in the Course of human events, it becomes necessary for one
people to dissolve the political bands which have connected them with
another, and to assume, among the Powers of the earth, the separate
and equal station to which the Laws of Nature and of Nature's God
entitle them, a decent respect to the opinions of mankind requires
that they should declare the causes which impel them to the separation.We hold these truths to be self-evident, that all men are created
equal, that they are endowed by their Creator with certain unalienable
Rights, that among these are Life, Liberty, and the pursuit of
Happiness.That to secure these rights, Governments are instituted among Men,
deriving their just powers from the consent of the governed, That
whenever any Form of Government becomes destructive of these ends, it
is the Right of the People to alter or to abolish it, and to institute
new Government, laying its foundation on such principles and organizing
its powers in such form, as to them shall seem most likely to effect
their Safety and Happiness. Prudence, indeed, will dictate that
Governments long established should not be changed for light and
transient causes; and accordingly all experience hath shown, that
mankind are more disposed to suffer, while evils are sufferable, than
to right themselves by abolishing the forms to which they are
accustomed. But when a long train of abuses and usurpations, pursuing
invariably the same Object evinces a design to reduce them under
absolute Despotism, it is their right, it is their duty, to throw off
such Government, and to provide new Guards for their future security.
...
We, therefore, the Representatives of the United States of America, in
General Congress, Assembled, appealing to the Supreme Judge of the
world for the rectitude of our intentions, do, in the Name, and by the
Authority of the good People of these Colonies, solemnly publish and
declare, That these United Colonies are, and of Right ought to be Free
and Independent States; that they are Absolved from all Allegiance to
the British Crown, and that all political connection between them and
the State of Great Britain, is and ought to be totally dissolved; and
that as Free and Independent States, they have full Power to levy War,
conclude Peace, contract Alliances, establish Commerce, and to do all
other Acts and Things which Independent States may of right do. And
for the support of this Declaration, with a firm reliance on the
Protection of Divine Providence, we mutually pledge to each other our
Lives, our Fortunes and our sacred Honor.";
The Rules and Regulations of the Colony of Georgia 1776 where it says: "the
people, with whom all power originates, and for whose benefit all government
is intended...";
The Constitution of Georgia; February 5, 1777 where it says: "... the people,
from whom all power originates, and for whose benefit all government is
intended...";
The Georgia Constitution of 1789 where it says: "Article VIII. All powers not
delegated by the constitution, as amended, are retained by the people.";
The Georgia Constitution of 1861 where it says:
"ARTICLE I - DECLARATION OF FUNDAMENTAL PRINCIPLES
1. The fundamental principles of Free Government cannot be too well
understood, nor too often recurred to.
2. God has ordained that men shall live under government; but as the forms and
administration of civil government are in human, and therefore, fallible hands,
they may be altered, or modified whenever the safety or happiness of the
governed requires it. No government should be changed for light or transient
causes; nor unless upon reasonable assurance that a better will be established.
3. Protection to person and property is the duty of Government; and a
Government which knowingly and persistently denies, or withholds from
the governed such protection, when within its power, releases from the
obligation of obedience.
17. Legislative Acts in violation of the fundamental law are void; and the
Judiciary shall so declare them.
27. The enumeration of rights herein contained shall not be construed to deny
to the people any inherent rights which they have hitherto enjoyed.";and finally,
The Petition and Declaration of Dependence on God
by Citizens of the Republic of Georgia;
Renewing the Covenant
dated October 9th, in the year of our Lord, 2000 where it says:"When in the course of human events, it becomes necessary for a
people to renew their national covenant with God, and to resume among
the powers of the earth that obedient station to which the Laws of
God bind them, a decent respect to the opinions of mankind requires
that they should declare the causes which impel them to the renewal.We hold these truths to be Biblically evident, that all men are
created equal before the Law of God and covenantally responsible to
Him. That they are endowed by their Creator with the possibility of
blessing or cursing depending on their obedient response to His
Covenant and its mediator, the Lord Jesus Christ. Faith in the death
and resurrection of Christ and subsequent obedience to His Word is
the only source of life, liberty and happiness for men and nations.That as one means of securing this Covenant, God has ordained the
institution of civil government, deriving its just power from God
alone. That whenever any form of government becomes disobedient and
destructive of these ends, it is the responsibility of its Christian
citizens to call the nation back to God, to pray for God’s mercy, and
use all Lawful means available to restore its foundations and
reorganize its powers according to the Word of God.The Word of God, indeed, will dictate, that when evils are no
longer sufferable, when a long train of abuses and usurpations,
pursuing invariably the same object, evinces a design to separate
them from their God and reduce them under absolute despotism, it is
the right, it is the duty, of duly ordained Christian leaders in
church and state to reprove such government and to restore those
biblical forms that will ensure their future security.Such has been the patient sufferance of the people of the
Republic of Georgia, and such is now the necessity which constrains
them to alter their present system of government. The history of the
present ruling class in this country is a history of repeated
injuries and usurpations, all having in direct object the casting
away of the Law of God and establishment of an absolute tyranny over
our Republic.To prove this, let facts be submitted to a candid world:
They have slain at the hands of the abortionist in excess of 30
million unborn infants.They have refused their assent to God's Laws the most wholesome
and necessary for the public good.They have obstructed the administration of justice, by refusing
to limit their judicial decrees to the stated intent of the
Constitution, the Bill of Rights, the state constitution and the
Bible.They have erected a multitude of new offices, and sent hither
swarms of officers, to harass our people, and eat out their
substance.They have combined with others to subject us to a jurisdiction
foreign to our constitution, and unacknowledged by our Law; giving
their assent to their acts of pretended legislation.For imposing taxes on us without our consent.
For depriving us, in many cases, (especially those related to
taxation) of the benefits of trial by jury.For declaring their own legislatures and bureaucracies invested
with power to legislate for us in all cases whatsoever.They are at this time advancing a comprehensive program –
legislative, economic, and cultural – to complete the works of death,
desolation, and tyranny, already begun with circumstances of cruelty
and perfidy, scarcely paralleled in the most barbarous ages, and
totally unworthy of a civilized nation.In every stage of these oppressions we have petitioned for
redress in the most humble terms. Our repeated petitions have been
answered only by repeated injury. A ruling class whose character is
thus marked by every act which may define a tyrant – rule apart from
Divine Authority – is unfit to govern the affairs of a Christian
people.Nor have we been wanting in attentions to our countrymen. We have
warned them from time to time, of their attempts to extend an
unbiblical jurisdiction over us and have participated in the election
of leaders professing to restrain this abuse to no avail. We have
reminded them of the circumstances of our emigration and settlement
here as a biblical Republic governed according to the Word of God. We
have appealed to their native justice and magnanimity and we have
conjured them by the ties of our common kindred to disavow these
usurpations, which would inevitably interrupt our connexions and
correspondence. They too, have been deaf to the voice of justice and
consanguinity. We must, therefore, acquiesce in the necessity which
impels us to this covenant renewal, and hold them adversaries in
rebellion against God and against our Republic.We, therefore, appeal to the Supreme Judge of the world and
do, in the name, and by the authority of the Holy Scriptures,
solemnly publish and declare that the Republic of Georgia is
a Free and Independent Republic under God, YHVH, the Father
of our Republic and Creator of our souls. We further solemnly
publish and declare that our servants in government must renew
their covenant to govern according to His Word, the Holy Bible,
and a constitution that is in full agreement with God's Word,
and that, as a Republic covenanted to God, they will have full
power to perform those duties which covenanted nations must of
biblical warrant do.We, therefore, petition the Christian leaders of the Republic
of Georgia to bring about the reconstitution of the Lawful
de jure Provisional Government of the Republic of Georgia to
serve until a Constitutional Convention is convened and a fully
operational de jure Republic that endeavors to fully protect and
defend our God-given Rights is instituted.And for the support of this Declaration, with a firm reliance on
the protection of the God of Covenants, we mutually pledge to each
other our lives, our fortunes, and our sacred honor."Article 3
Boundaries of the Nation
That by the institution of this Provisional Government, The Republic of Georgia
shall not extend any boundaries past those which are the present-day Georgia
boundaries.
Article 4
Creation of Government
The Provisional Government of Georgia shall consist of a General
Council. All members shall be elected from the Provisional Government
Convention so called. Subsequent vacancies shall be filled by the body
of the General Council.Article 5
Powers of the General Council
Section 1. The following positions, in order of chain of command, shall
comprise the General Council: President, Vice-President, Secretary of
Council, Advocate General, Secretary of Defense, Secretary of the
Interior, Treasurer, Auditor.There shall be elected the following positions to the General Council
from the floor of the Convention:
President
Vice-President
Secretary of Council
Advocate General
Secretary of Defense
Secretary of the Interior
Treasurer
AuditorSection 2. The General Council shall devise ways and means to assist the
President in the discharge of his duties; develop and implement a plan
for the transition of the existing de facto government operating on the
soil of Georgia; provide for this plan to encompass privatization,
decentralization, deregulation, and elimination of governmental excess;
and secure limited government. The General Council shall pass no law
except as required in case of national emergency.Section 3. Two-thirds of the members of the General Council shall form a
quorum to do business as long as the President and the Secretary of
Council is present.Section 4. The General Council shall have the authority to hear and
judge all cases concerning the administration of the Lawful de jure
Provisional Government of the Republic of Georgia. This court is
designated as the High Court of Government Administration. All
Citizens and inhabitants upon the face of the earth are recognized
to have God-given Rights, consequently all forms of admiralty law
are abolished, however, until the fully operational and Lawful
de jure Government of the Republic of Georgia is established by
way of Constitutional Convention, the General Council will serve
as the High Court of Government Administration in the place of the
Common Law Jury in all cases concerning the administration of the
Lawful de jure Provisional Government of the Republic of Georgia.Section 5. The General Council shall have limited power to make treaties
that do not harm or infringe the God-given Rights of the Citizens of
Georgia or of any inhabitant upon the face of the earth, and to authorize
ambassadors and consuls of the Republic of Georgia.Article 6
Duties and Responsibilities of Officers
Section 1. The officers of the Republic of Georgia shall be governed by
this document and subsequent attachments or amendments, in accordance
with God's Common Law.Section 2. The President shall be the chief executive and chief
spokesman for the Republic of Georgia. He shall be keeper of the Great
Seal of the Republic of Georgia. When the General Council is
seated as the High Court of Government Administration, he shall
preside as Chief Magistrate. He shall be the Commander-in-Chief of
the Republic of Georgia Defense Forces.Section 3. The Vice-President shall be responsible for moderating and
coordinating all meetings of the General Council. He shall perform the
official duties of the President in case of absence or inability of the
President.Section 4. The Secretary of Council shall serve as archivist for the
provisional government, keeping records of all the minutes of meetings,
all general records of the Council, and all acts and actions of the
Council in due operation. At meetings of the General Council, the
president will surrender the Great Seal to the Secretary for use and
endorsement of all actions therein enacted and attested to as the
Government of the Republic with the President's signature and the
Secretary's endorsement as witness then sealed by the Great Seal.
He shall be responsible for the issuance of Georgia passports, and
shall maintain a duplicate repository of information and documentation
for the offices of the General Council. He shall serve as liaison to
foreign nations and shall direct ambassadors and consuls of the Republic.Section 5. The Secretary of Defense shall serve as liaison to all
commanders of the Republic of Georgia Defense Forces. He shall be
responsible for the design and implementation of programs to
facilitate the organization and preparation of the Republic of
Georgia Defense Forces. He shall answer directly to the President
and to the General Council.The Secretary of Defense will serve as the Chief Coordinating Officer
with all Constables, Sheriffs, and Police and with Commanders of Land,
Sea, and Air Defense Forces. The Secretary of Defense will be
responsible for the appointment of all County Sheriffs and Constables,
under the direction of the Council. The Secretary may re-appoint any
Sheriff or Constable if, in his opinion, the Sheriff or Constable is
performing his duties satisfactorily.Section 6. The Advocate General shall be responsible for representing
the Republic in all domestic legal matters and in all legal actions
undertaken for the protection of the people of the Republic.Section 7. The Secretary of the Interior shall be responsible for the
formulation of programs and plans to facilitate the privatization of
Georgia public lands, to assist in restoring local government and
educational control to the people of Georgia, and to encourage the
introduction of new products and technologies to advance and expand
Georgia industries and agriculture.Section 8. The Treasurer shall be responsible for collecting, holding,
and disbursing assets and shall provide the General Council with a
quarterly accounting.Section 9. The Auditor shall be responsible for the maintenance and
accountability of officers of the Council and the Republic or its
agencies to properly and at all times account for the distribution
of all funds.Article 7
Operations of Meetings
Section 1. All meetings conducted by this provisional government shall
operate according to the rules and procedures ofas the final authority, with

as a training manual.Section 2. At all meetings of the General Council, the President will
surrender the Great Seal to the Secretary of Council for use. The Great
Seal of the Republic of Georgia shall be affixed in endorsement of all
actions enacted and attested as done by the provisional government of the
Republic of Georgia, with the President's and Secretary of Council's
signature as witness and the endorsements of all concurring General
Council members.Signed and executed by the delegates in convention and attested by the
secretary of the convention, done the _______ day of ___________________
in the year of Our Lord two-thousand and _________, now of record and
maintained in the archives of the Republic of Georgia; and in witness
whereof the Great Seal of the Republic of Georgia is affixed.President of the Convention
